Alabama state statute 13A-12-211 details what constitutes "Unlawful distribution of controlled substances":

(a) A person commits the crime of unlawful distribution of controlled substances if, except as otherwise authorized, he sells, furnishes, gives away, manufacturers, delivers or distributes a controlled substance enumerated in Schedules I through V.

(b) Unlawful distribution of controlled substances is a Class B felony.

In a distribution case, the prosecution is required to prove beyond a reasonable doubt that you furnished, delivered, or gave away drugs to another person. Notice that a sale is not required: if you give your mother a Lortab to relieve a bad headache, you could be charged with distribution.

Distributed Drugs

Statistics show that drug offenses are often related to other crimes. Studies have shown that the use of illegal drugs makes someone more likely to commit crimes such as theft or assault. As a result, Alabama aggressively prosecutes distribution and trafficking cases. The most common drugs being distributed are the following:

  • Cocaine/Crack Cocaine
  • Marijuana
  • Crystal Meth / Methamphetamine
  • Ecstasy (XTC or MDMA)
  • Heroin
